Definition – “Wine” refers to enological products, including red, white, rose, port, champagne, or other product of enological nature that is of the commonly accepted wine category.

MINORS AND LEGAL CAPACITY

Ordinance No. 59-107 of 7 January 1959, Law No. 74-631 of 5 July 1974 and Article L.3353-3 of the Public Health Code prohibits the sale of alcohol to minors. Any customers ordering wine at Château Fonrazade therefore commit themselves to be 18 years old on the date of the order.

Article 1:

Application of general conditions of sale These terms and conditions (hereinafter Terms and Conditions) apply to all sales of products by Château Fonrazade on its internet store.

The placing of an order implies acceptance by the buyer of the Terms and Conditions to the exclusion of any other document such as brochures or catalogs issued by the seller, of which the value is only indicative.

Any modification of the Terms and Conditions only apply to sales made after the modification, the date on these present pages and on the receipt of the order sent to the buyer are to be considered valid.

Offers on the site are reserved exclusively for private clients, to the exception of professional dealers.

Château Fonrazade reserves the right, for any new customer, to ask for a proof of identity and residence before the final confirmation of the first order.

Article 2: The Prices

1. Our sales prices are those indicated on the catalog site when ordering. The electronic catalog is regularly updated.

2. All Prices are in US Dollars, shipping included.

Article 3: Content of the order

The order must strictly comply with the offer as issued on the site, including the formats available, quantities and deadlines.

Article 4: Order Procedure

1. The order assumes prior knowledge taken by the customer of these conditions, the price and the essential characteristics of the selected wines, available on the site.

2. Ordering is via the order form available online on the site of Château Fonrazade.

3. The buyer communicates the requested information necessary for the completion of the sale, in the zones "Customer Area". He takes care on this occasion not to omit any information necessary for the proper execution of delivery, such as a possible code of access to the building.

4. The buyer is identified through his or her e-mail address and personal password.

5. The buyer accepts the order by clicking "Confirm" after choosing the manner of its payment and entering the information required to enable it, in the zones provided for this purpose. Acceptance is final, subject only to the possible exercise of his right of withdrawal described below.

6. Château Fonrazade confirms the order to the buyer via e-mail summarizing the order, as well as the procedures for exercising the right of withdrawal, the address of the seller to whom the buyer may submit any claims, and information about the after-sales service and commercial guarantees.

7. All orders are considered firm and final, after payment is received and confirmed by us.

Article 5: Payment

An order of available wine can be validated only if it is accompanied by payment by credit card of the full price.

Article 6: Methods of payment

By credit cards (Carte Bleue, Visa, Eurocard / Mastercard,…), indicating in the zones provided for this purpose (secured by SSL encryption) the card number, without spaces between numbers, the date validity and the three-digit security number on the back of the card. By Paypal Transfer (A Paypal Account is required). The information is encrypted and undecodable. Château Fonrazade has no access, only the acknowledgment of the correct transaction of your payment reaches us.

Article 7: Transfer of ownership

The transfer of ownership to the buyer of the wines is delayed until the full payment of the order.

Article 8: Availability of goods

The offers are made subject to available quantities. In case of unavailability of the ordered wine and subsequent cancellation of the order, the price will be refunded to the buyer as soon as possible.

Article 9: Destruction

In case of destruction of the goods before the date for delivery of the order, if stock is not available to carry out its replacement, the buyer will be refunded the amount paid by him, to the exclusion of any other compensation, within 30 days of the date of the loss.

Article 10: Delivery

Delivery assumed by Iziwine.com

The information provided on this website is provided on ‘as is’ basis. To the fullest extent of the law, Iziwine limits its liability, while preserving the consumer protections granted under statutory law.

Customs – Iziwine makes every effort to abide by US Customs regulations. As a 100% souvenir wine service, Iziwine does not engage in the service of commercial wines. (For some members, we can arrange the re-order of specific wines previously transported as souvenir through an affiliate) All orders are undertaken in compliance with Customs regulations to wherever destination the wine is intended. As all entries are subject to discretionary review by local Customs authorities, Iziwine cannot be held liable for delays, re-classifications, or seizure of any wine in any country.

Refunds Policy – Iziwine is a guaranteed service. The guaranty provides for the replacement or refund of the loss, at the discretion of the company. If the wine cannot be replaced, a Iziwine representative will contact the traveler to arrange an equitable solution."Iziwine replacement policy covers up to $500 per bottle, unless a specific value is approved by management".

Refusal of Delivery – Our stand as a merchant service provider is that "Iziwine is prepared to complete the service in keeping with our delivery contract. No refund will be provided once the wine has departed from the origin country unless specifically provided in writing. Failure to receive or make reasonable arrangements to receive the wine will constitute an abandonment of same. Such abandonment will mean forfeiture of the wine and service fees".

Interruption of Service – Iziwine will not be in breach of its agreement in the event that it is unable to complete its service in a timely manner due to events beyond its control. Such may include weather, fire, flood, war, civil disturbance, acts of government or other authorities, industrial action, or actions by a 3rd party.

Export Authorization "Shipper authorizes Iziwine , or its designated agents to process Exportations in the locality where the wine is received for transport. Shipper includes, but is not limited to, any Wine business, Winery, Wine Shop, or Wine Tour Operator. Shipper agrees to furnish the relevant supporting documents required for each transaction. This documentation includes, but is not limited to, Government, Transport, or Food & Drug Identification Numbers as needed. Copies of executed documents shall be made available to each Wine business upon request. Please contact the Director for any question.

Contraband - Transport of contraband is unlawful and subject to full prosecution by the legal system of the traveler’s residence.

Security – All shipments must be tendered from a known address; local security considerations may require additional time for carriage. No consignment will be accepted from individuals.

*USA Residents - Limitations - Attention high valued shipments

Shipments valued over $500 per bottle will incur a 3% valuation fee based on the total value of the wine.

For all DDP/Gift shipments an additional $45 handling charge will be added to the order.

Article 11: Faculty of retraction

Products damaged after delivery will not be accepted as returns. The buyer who uses this faculty will be required to proceed under his or her own responsibility and at his or her own expense, to return the ordered goods to the wine cellars of the seller.

Article 12: Quality of the wines

The wines are exclusively Appellation of Controlled Origin (AOC) Saint-Emilion Grand Cru, and have never left our cellars located in Saint Emilion. Château Fonrazade can not be held responsible for any damage to the quality of the wines caused by transport.

Article 13: Force majeure (Circumstances beyond our control)

Château Fonrazade can not be held responsible for any loss, damage or non-delivery of an order resulting from a force majeure (such as storms, floods, road accidents).

Article 14: Jurisdiction

The Customer Service of Château Fonrazade is at your disposal to resolve amicably any problem resulting from an order and its delivery. If it is not possible to reach an agreement, all disputes arising from the delivery of an order or the interpretation of these present conditions, and more generally any kind of agreement concluded between the parties, will be referred to the competent court of law.
